Welcome to Kivdaa Cars Rental. By accessing and using our services, you agree to comply with the following Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In this Agreement, unless the context otherwise requires:

• “Company” refers to Kivdaa Cars Rental, operating from 20/6, Sahapur Colony, Plot No. 108, New Alipore, Kolkata - 700053, West Bengal, India.
• “Customer” refers to any individual or entity using the services of Kivdaa Cars Rental.
• “Vehicle” means the rental car provided to the Customer under these Terms.
• “Driver” means any chauffeur provided by the Company for a chauffeur-driven rental service.

2. Eligibility

To avail of our services, the Customer must:

• Be at least 21 years old for Economy & Sedan rentals and 25 years old for SUVs & Luxury vehicles.
• Possess a valid Driving License (for self-drive rentals).
• Provide valid government-issued ID proof.
• Agree to these Terms and Conditions.

3. Booking and Payment

All bookings are subject to the availability of vehicles. The Company reserves the right to accept or reject bookings based on internal policies.

• A booking is confirmed only upon successful payment of the required deposit.
• Full payment must be made before vehicle pickup or service commencement.
• Any additional charges incurred (e.g., tolls, parking fees) shall be borne by the Customer.
• For non-corporate bookings without service contracts, an advance payment is mandatory.

4. Cancellation and Refund Policy

Cancellation policies are as follows:

• Cancellations made more than 48 hours before the booking start time: **90% refund**.
• Cancellations made within 24-48 hours: **50% refund**.
• Cancellations made within 24 hours or no-show: **No refund**.
• Refunds, if applicable, will be processed within 7-10 business days.

5. Vehicle Usage and Responsibilities

The Customer agrees to use the rented vehicle responsibly and adhere to traffic regulations.

• Self-drive rentals must not be used for illegal activities or sub-letting.
• The Customer shall be responsible for any fines, penalties, or damages incurred.
• Vehicles must be returned in the same condition as at the time of rental.
• Smoking, alcohol consumption, and transportation of illegal goods are strictly prohibited.

6. Insurance and Liability

All vehicles are insured under third-party liability. However:

• Insurance does not cover damages due to reckless driving or negligence.
• The Customer is liable for any damages exceeding the insurance coverage.
• The Company is not responsible for lost or stolen personal belongings.

7. Chauffeur-Driven Services

For chauffeur-driven rentals:

• The assigned driver shall follow the pre-scheduled itinerary.
• Additional hours beyond the booking period will be charged at standard hourly rates.
• Night charges apply for services between **11:00 PM and 6:00 AM**.

8. Fuel Policy

Fuel policy for rentals:

• Self-drive rentals are provided with a full tank and must be returned with a full tank.
• For chauffeur-driven rentals, fuel costs are included in the total booking price.

9. Late Returns & Additional Charges

Late return penalties apply as follows:

• Delay of up to 2 hours: **10% of daily rental fee**.
• Delay beyond 2 hours: **Full day's rental charge**.
• Unauthorized extensions will be charged at a premium rate.

10. Terms of Outstation Rentals

For outstation rentals:

• A minimum of **250 KMs per day** will be charged.
• Outstation driver allowance: **₹300 per day**.
• Garage-to-Garage time and KM calculations apply.

11. Termination of Rental Agreement

The Company reserves the right to terminate the rental agreement if:

• The Customer violates the Terms and Conditions.
• The vehicle is used for any illegal or prohibited activity.
• Payment terms are not met as agreed.

12. Dispute Resolution

In case of any disputes, the following shall apply:

• All disputes shall be governed by the laws of **India**.
• Any legal proceedings shall be conducted in the courts of **Kolkata, West Bengal**.

13. Changes to Terms & Conditions

The Company reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is the Customer’s responsibility to review the terms before booking.
